Procurement and Concessions

Transparency, regulatory compliance and robust procurement procedures took centre-stage as Malta Investments & Economic Advisory (MIEA), in collaboration with Ganado Advocates, hosted a half-day seminar examining the latest legal developments affecting public tenders and concessions.

Held at The Excelsior Hotel, the highly informative session entitled ‘Concessions Under the Spotlight: Latest Case Law and Regulatory Changes’, brought together legal experts, high public sector officials and government subsidiary reġresentatives to discuss recent landmark judgments, European Union directives and regulatory reforms shaping Malta’s public procurement framework.

The event emphasised on public procurement, legal scrutiny, whereby contracting authorities and private operators are expected to meet increasingly stringent standards of transparency, accountability and governance.

Effective procurement procedures are fundamental to protecting public funds, ensuring fair competition and maintaining confidence in the awarding of public contracts. Compliance with procurement legislation is not merely a legal obligation but a cornerstone of good governance that helps deliver value for money while reducing the risk of disputes and project delays.

The event also highlighted the Genoa incident where safety procurement procedures failed.

Throughout the session, legal experts analysed key court judgments and discussed how evolving interpretations of procurement law are influencing tender evaluation, concession agreements and the implementation of EU directives.

The joint collaboration between MIEA and Ganado Advocates reflects a shared commitment to strengthening knowledge of procurement law and supporting both public entities and private businesses in navigating an increasingly regulatory environment.
